Welcome to Tracer. These Terms of Service (“Terms”) are a binding agreement between you and Tracer, Inc. (“Tracer,” “we,” “us,” or “our”) and govern your use of the Tracer app and tracerclub.com (the “Services”). Please read them carefully — they include an arbitration agreement and class-action waiver that affect your legal rights.
Tracer lets you track runs and activities, share them, follow others, join groups, compete on leaderboards, broadcast live, support creators, and raise money for causes. We may add, change, or remove features at any time. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose, subject to these Terms.
You own the content you create — your runs, photos, videos, captions, comments, and posts (“User Content”). You keep all rights you have in it.
To operate the Services, you grant Tracer a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, adapt (e.g. resize images, generate share cards, and create map “ghost traces”), publish, publicly display, and distribute your User Content for the purpose of operating, promoting, and improving the Services and as permitted by your audience and privacy settings. This license ends when you delete the User Content or your account, except for content others have re-shared, content retained in backups for a limited time, and anonymized or aggregated data.
Routes and the community map. Activities you record may be displayed publicly on the Tracer map as ghost traces according to your privacy settings, and a route you record (with any attached photo) may be selected and added to Tracer’s curated route library with attribution to you. You can opt a run out of public display by marking it private.
You represent that you have the rights to the User Content you submit and that it does not violate these Terms or anyone’s rights.
Tracer is a place for athletes, creators, and supporters — including solo athletes, women training alone, minors, and public figures. To keep it safe for everyone, these rules apply to everything you post, broadcast, stream, or fundraise. We model our content standards on mainstream social platforms such as Instagram. We have zero tolerance for objectionable content and abusive behavior.
Tracer is not an adult platform. No nudity, pornography, sexual content, or sexualized images of yourself or others — including in profile photos, posts, captions, live broadcasts, comments, group content, or creator/exclusive-tier content. This includes sexually suggestive content and content that exists primarily for sexual gratification. As with Instagram, limited exceptions may apply to content that is clearly artistic, educational, or health-related (for example, post-mastectomy imagery or breastfeeding), at our discretion.
No content that breaks the law — including illegal drugs, weapons sales, threats of violence, or any content sexualizing or endangering minors. Content involving minors must always be appropriate.
No targeted abuse, bullying, slurs, or content that attacks or demeans people based on race, ethnicity, national origin, gender, gender identity, sexual orientation, religion, disability, age, or body. Never share another person’s home address, workplace, or live location without their consent.
Decoy modes (“Mars”/“Moon”) and private runs are safety features. Don’t try to deduce, screenshot, expose, or work around someone’s hidden location. Doing so is grounds for a permanent ban.
No content that promotes, incites, or glorifies violence, terrorism, self-harm, suicide, or eating disorders, or that encourages dangerous activities.
Don’t pose as another person, brand, or organization. No spam, get-rich-quick schemes, fake giveaways, malware, or pushing followers to deceptive off-platform links.
Don’t scrape, reverse-engineer, overload, or interfere with the Services or their security, attempt unauthorized access, or use bots to manipulate engagement, leaderboards, or donations.
Donations to nonprofit campaigns are processed through our donation partner (Pledge.to). Tracer is a technology platform, not a charity, broker, or financial advisor, and does not guarantee that funds raised will be used as described by an organizer. Donations may be non-refundable and tax-deductibility depends on the recipient and your jurisdiction — consult your own advisor. We may remove campaigns that appear fraudulent or that violate these Terms.
Tracer is not a medical device or medical service and does not provide medical advice. Activity data, pace, heart-rate, and insights are for informational and motivational purposes only.
Consult a physician before beginning any exercise program. You participate in physical activity at your own risk. Be aware of your surroundings, obey traffic and trail rules, and stop if you feel unwell. Tracer is not responsible for any injury, health condition, or harm arising from your use of the Services or from physical activity you undertake.
GPS, maps, distance, pace, elevation, and routing are estimates and can be inaccurate due to device, signal, weather, or map-data limitations. Do not rely on the Services for navigation, emergency, or safety-critical decisions. You are responsible for choosing what location information to share and with whom; see our Privacy Policy for the controls available to you.
The Services integrate third parties such as Stripe, Pledge.to, Spotify, Apple Music, Garmin, Strava, Mapbox, and Apple/Google. Your use of those services is governed by their own terms and privacy policies, and Tracer is not responsible for them. Connecting a third-party account is optional and you can disconnect it at any time.
The Services — including the Tracer name, logo, software, design, and content we create — are owned by Tracer, Inc. and protected by intellectual-property laws. Except for the limited license to use the Services granted above, we reserve all rights. You may not copy, modify, distribute, sell, or create derivative works from any part of the Services without our permission. We welcome feedback, and you grant us the right to use any feedback you provide without restriction or compensation.
You may stop using the Services and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms, if required by law, or to protect the Services or other users. Sections that by their nature should survive termination (including content license for already-shared content, payment obligations, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TRACER DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR ACCURATE, OR THAT ANY CONTENT OR DATA WILL BE PRESERVED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, ANY USER CONTENT, ANY THIRD-PARTY CONDUCT, OR ANY PHYSICAL ACTIVITY UNDERTAKEN USING THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACER’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TRACER IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. THESE LIMITATIONS FORM AN ESSENTIAL BASIS OF THE AGREEMENT.
You agree to defend, indemnify, and hold harmless Tracer, Inc. and its officers, directors, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Services, your violation of these Terms or applicable law, or your infringement of any third party’s rights.
